The cause for approaching this Court was apprehension in the mind of the applicant of his arrest in connection with Crime No.74/2017, registered with Police Station, Yashodharanagar, Nagpur for an offence punishable under Sections 65 (A), (D), (E), (F), 81, 83 and 108 of the Bombay Prohibition Act.
When the matter was listed before this Court on 01.09.2017, looking to the nature of accusation made against the present applicant, this Court had granted ad interim bail on a condition that the applicant shall attend the investigating officer i.e. the State Excise Department on 03.09.2017, 04.09.2017, 05.09.2017, 06.09.2017 and 07.09.2017 between 11.00 a.m. to 6.00 p.m.
Today, when the matter is listed, learned counsel for the applicant submits that as per the directions, the applicant has attended the investigating
aba626.17.odt officer on the aforeasid dates and he was with the investigating officer from 11.00 a.m. to 6.00 p.m. This particular statement is not controverted by the learned A.P.P. The learned A.P.P. further submits that the applicant has extended full cooperation to the non applicant and his interrogation is complete. He submits on instructions that the State Excise Department is not in need of custodial presence of the applicant. In that view of the matter, the application is allowed. Ad interim bail granted to the applicant on 01.09.2017 is confirmed.
The application stands disposed of accordingly.
