DATE : 19-10-2023 It is not in dispute that what was being transported in the instant matter was not sand but Gitti, which would not require any transit pass in view of the judgment of this Court in Subhash s/o Yadavrao Matte Vs State of Maharashtra and others WP 400/22 decided on 22-03-2022, considering which, the impugned order is hereby quashed and set aside and the vehicle is directed to be released in favour of the petitioner, unless it is not so required in any other offence.
