DATED : 28-01-2019 Learned Additional Public Prosecutor points out order dated 29-8-2017 passed in Criminal Application (APL) No.324/2017 whereby prosecution is restrained from filing charge-sheet. Similar order is passed in Criminal Application (APL) No.656/2016 on 07-10-2016 restraining non-applicant No.1/State from filing chargesheet and has stated that in view of the said orders, no charge-sheet could be filed though investigations are complete.

In the circumstances, learned Counsel for applicants seeks leave to withdraw both the applications with liberty to file application seeking discharge. 3.

In that view of the matter, we recall orders dated

2 apl656.16,324.17 07-10-2016 and 29-8-2017 thereby allowing prosecution to file charge-sheet within a week before the competent Court.

Leave as prayed is allowed. Applications stand disposed of as dismissed as allowed to be withdrawn with liberty as prayed for.
