02] The petitioner-husband has challenged the order dated 14/08/2021 passed on Exh.9 by the learned Magistrate in O.M.A. No.15/2020, whereby the petitioner-husband was directed to provide caste certificate of respondent No.2-Son. 03] The petitioner's learned Counsel would submit that without prejudice to his rights, he has obtained caste certificate of his son Sumit and today it is handed over to the learned Counsel appearing for the respondents. 04] It is brought to the notice that the respondent-wife has filed criminal contempt bearing O.M.C. No.136/2021 in the Court of Magistrate, Pulgaon alleging breach of the same impugned order dated 14/08/2021. The respondents' learned Counsel made a statement that since the caste certificate has been handed over to him, he would not prosecute the aforesaid criminal contempt and would withdraw the same.

16.cwp.887 2/2 05] In view of the above statement, the petitionerhusband seeks for withdrawal. In that view of the matter, the petition stands disposed of as withdrawn. The statement made by the respondents' learned Counsel is taken as an undertaking to the Court.
