Heard Shri Bastian, learned counsel appears for the appellant and Shri Najbile, learned counsel for the respondent.

This is the Husband's Appeal against the judgment and decree passed by the Judge, Family Court, Nagpur, in D-Petition No. 09 of 2016 whereby the custody of the minor daughter Riddhi, aged about 7 years was granted to the respondent - wife. 3.

Today, the learned counsel appearing on behalf of the respective parties are present and submit that the parties have entered into terms of settlement out of court. The learned counsel have

0803fca63.16 filed joint Settlement Terms signed by both the parties and their counsel. The Settlement Terms are taken on record and marked as "X" for identification. 4.

We have perused the Settlement Terms and found the same to be legal and feasible. As per these terms, the respondent - wife has agreed to handover the custody of minor daughter - Riddhi to the husband on the date the parties file a joint petition for Divorce by mutual consent, under Section 13-B of the Hindu Marriage Act. The parties have also settled terms with regard to the custody of the minor daughter with the respondent - wife during week ends and during Vacations.

The learned counsel request this Court to pass the decree in terms of the Settlement Terms. 6.

As the matter is settled between the parties out of court, Family Court Appeal No. 63 of 2016 stands disposed of and the decree be drawn according to the Settlement Terms. The parties to bear their own costs.
