Mr. A.P.Chutke, APP for Respondent/State CORAM : AVINASH G. GHAROTE, J.
DATE : 17/01/2022 Heard Mr. Mahajan, learned counsel for the applicant. He submits that there is no motive attributable to the applicant for the alleged offence under Section 307 of the IPC and therefore the applicant is entitled to bail. The facts availing on record indicate that the marriage of the applicant with the victim took place on 14.3.2021. On 16.3.2021 the applicant along with the victim/ wife had been to reside at his in-laws, and had asked the victim to accompany him for a walk early in the morning, which was declined by the victim. Thereafter, in the afternoon at about 11 a.m., the applicant has assaulted the victim/wife of merely two days, by a shaving blade on the neck for refusing to go with him, for a walk. In my considered opinion, the above said fact do
14ba1307.21.odt not make me inclined to accept the application for bail, as there are incise wound of 1 mm x 5 cm and 2 mm x 6 cm over throat at crico thyroid junction of the wife, which could have been fatal. I am therefore not inclined to entertain the application, the application is rejected.
