This is an application for condonation of delay caused in filing appeal against judgment and order dated 10.11.2021 passed in Criminal Summary Case No.11/2015, whereby the learned Trial Court acquitted the non-applicant no.2.

Heard learned Advocate for the applicant and learned Additional Public Prosecutor for non-applicant no.1. Though non-applicant no.2 is served, he is absent.

It is stated that the applicant was not aware of the judgment and order. It is stated that the evidence adduced in the matter needs re-appreciation. It is stated that judgment and order needs reconsideration. It is stated that the applicant-victim has right to file appeal. It is submitted that there is delay of 60 days.

In view of the facts and circumstances, the delay caused in filing the appeal is condoned.
