After considering the fact that investigation is in progress and in the reply it is stated by investigating officer that test identification parade has to be conducted, when the Court expressed its opinion that the Court is dismissing the application, Mr. Rai would submit that he be permitted to withdraw the present application.

The application is dismissed as withdrawn with liberty to file application before the trial Court after filing of the charge-sheet.
