The applicant/appellant State has filed this application seeking condonation of delay of 8 days in filing appeal challenging the order of acquittal passed by the Special Judge, Amravati in Special Criminal Case No. 2/2014.

Initially notice was issued to respondent/ accused, which was served. Despite

Order 0112appa801.19 service of notice, there is no appearance on his behalf.

I have heard learned A.P.P. and gone through the reasons canvassed to explain the delay. Having regard to the reasons and as the delay is marginal, the application deserves to be allowed. Accordingly, the application is allowed. Delay is condoned. Office is directed to register the appeal and list the same for admission.

Criminal Application stands disposed of.
