DATED : OCTOBER 10, 2019 At the outset Mr. Jawade, learned Additional Public Prosecutor for the non applicantState submits that the trial has already commenced and tomorrow is the date for recording of evidence. The statement accepted.

In view of the aforesaid statement Mr.

Mirza, the learned counsel for the applicant submits that he wishes to withdraw the present application. He however submits that direction be given to the learned Magistrate for early disposal of the trial. The application is disposed of as withdrawn. The learned learned Judicial Magistrate First Class, Telhara before whom Regular Criminal Case No.72/2019 is pending, shall decide it as expeditiously as possible not later than six months from the receipt of this order, since the applicant is under trial prisoner.

It is made clear that case of the present applicant was not heard on its own merits.
