By this writ petition, the petitioners challenge the action on the part of the respondent No.2-Hindusthan Petroleum Corporation Limited of cancellation of the advertisement pertaining to the allotment of the petrol pump near the railway crossing before Pagalkhana Chowk in Nagpur.

We are not inclined to interfere with the action on the part of the respondents in the year 2016 in respect of the cancellation of the advertisement pertaining to the allotment of concerned petrol pump in the year 2003. Merely because the petitioner belongs to reserved category and had applied for the said petrol pump, it cannot be said that the respondent No.2 was not entitled to cancel the idea of allotment of concerned petrol pump near the first railway crossing, as a retail outlet of petrol pump was already existing in the vicinity of the concerned area. Since we do not find any fault in the action of the respondent No.2 in withdrawing the advertisement of the year 2003 in respect of the allotment of petrol pump near the railway crossing due to existence of another petrol pump in the vicinity, the writ petition is liable to be dismissed.

Hence, we dismiss the writ petition with no order as to costs. Rule stands discharged.
