This is an application for anticipatory bail. Heard Mr. Muhammed Ateeque, learned Adv., for the applicant, and learned APP Mrs. Jachak for the respondent-State.
The First Information Report is lodged by the prosecutrix herself. Looking to the nature of the accusations made in the First Information Report against the present applicant, this Court is in agreement with the learned Additional Public Prosecutor that in order to scotch any apprehension in the mind of the investigating
agency, the applicant shall attend the Police Station on every alternate day till filing of the charge-sheet. This is because, according to learned APP, the entire investigation is over and only a formality of filing of a charge-sheet is to be done and it will be done within a period of four weeks from today. Hence the following order:-
O R D E R
[a] Criminal Application [ABA] No. 516 of 2015 is allowed.
[b] In the event of his arrest in connection with Crime No. 131/2015 registered with Ladkhed Police Station, Distt. Yavatmal, for the offences punishable under Sections 354-A (1) (I), 509 and 506 of Indian Penal Code, 12 of the Protection of Children from the Sexual Offences Act, 2012, and 3 (1) (xi) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, the applicant Rizwan Husen Baig be released on bail on he executing a Personal Bond of Rs. 10,000/- [rupees ten thousand only] with one solvent surety in the like amount.
[c] The applicant shall attend Ladkhed Police Station, Distt. Yavatmal, on alternate day
staring from 26th October, 2015 for a period of four weeks, i.e., the time limit within which the charge-sheet shall be filed, as stated by learned APP.
[d]l The applicant shall not extend any threat to the prosecutrix.
With this, the application is allowed and disposed of.
