Heard Mr. V.K. Gulhane, learned Adv., for the applicant, and learned APP Mr. Sonak for the respondentState. The applicant is apprehending his arrest in connection with Crime No. 155/2015 registered with Police Station, Sonegaon, Nagpur, for the offence punishable under Section 420 of Indian Penal Code. According to the reply filed on behalf of the prosecution before this Court in the present application, one Shri Dhanraj Petric, who is an Engineering Advisor in respect of mines of Manganese Ores, was planning to start his own business, and for that, he was requiring a
capital of Rs. 50,00,000/-. According to prosecution case, he contacted the present applicant and the present applicant had suggested the name of Shagun Group of Finance Company.
It is not the case of the prosecution that the present applicant is in any way concerned with the said Shagun Group of Finance Company. Further, it is not the case of the prosecution, as could be seen from the reply, that the present applicant, at any point of time, promised the first informant that he will be receiving any loan amount. Further, it is also not the case of the prosecution that the present applicant has obtained any pecuniary advantage from the complainant. The allegation against the present applicant is that the documents, which were required by that Shagun Group of Finance Company, were transmitted from the e-mail address of the present applicant. With such type of allegations against the applicant, in my view, the custodial presence of the applicant is not necessary. The apprehension of the prosecution can be taken care by directing the applicant to attend the Police Station once in a fortnight as prayed by the learned APP for the State. Hence the following order:_
O R D E R
[a] Criminal Application [ABA] No. 517 of 2015 is allowed.
[b] In the event of his arrest in connection with Crime No. 155/2015 registered with Sonegaon Police Station, Nagpur, for the offence punishable under Section 420, Indian Penal Code, the applicant Rajendra Narayansingh Yadao be released on bail on he executing a Personal Bond of Rs. 25,000/- [rupees twenty-five thousand only] with one solvent surety in the like amount.
[c] That the applicant shall attend Sonegaon Police Station, Nagpur, once in a fortnight, i.e., on first and fourth Friday of every month till filing of the charge-sheet, and on these two days, he shall be in the Police Station from 2.00 p.m., to 5.00 p.m.
With this, the application is allowed and disposed of.
