Mr. S. Meshram, Advocate for applicant.
Mr. T. A. Mirza, A.P.P. for non applicant-State. CORAM : V.M. DESHPANDE, J.
DATED :
SEPTEMBER 7, 2017 This is the third successive bail application filed on behalf of the present applicant after filing of the charge-sheet. The applicant, no doubt is entitled to file as many applications as he wants. However, at the same time, applicant has to point out change in circumstance on every occasion for considering his application for bail. Mr. Meshram, learned counsel for the applicant fairly states that there is no change in the circumstance and the only circumstance is that the applicant is behind the bars since last 17 months. In my view, that cannot be the change in circumstance. When this court was about to dismiss the application, the learned counsel for the applicant submits that he has instructions to withdraw the application. The application stands dismissed as withdrawn.
