The applicant is arrested in Crime No.822/2024 registered with Police Station Kondhali, District Nagpur for the offences punishable under Sections 310(2), 318(4), 316(2), 204, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The allegations made against this applicant are that he duped many persons by saying that he will give coins of Gold of Rs.40,00,000/-.

The learned Counsel for the applicant has stated that the matter is settled between the parties. The application for quashing of the First Information Report is filed by filing joint pursis by the non-applicant before the Division Bench of this Court. The complainant was present before the Court on that day. In said matter, the learned A.P.P. has obtained time to place on record the antecedents, if any, against the applicant and the matter was adjourned.

The learned Counsel for the applicant has stated that the matter is settled between the parties, there

2 29.ba.940.25 is no reason to keep the applicant behind bar. 6.

The learned Counsel for the non-applicant No.2 has stated that the matter is settled and has no objection to release the applicant on bail 7.

The learned A.P.P. opposed the application stating that it is the matter between the State and the accused. There are many offences against this applicant. Settlement of matter between the applicant and the victim cannot be a ground to release the applicant on bail as the First Information Report is not yet quashed. Hence, prayed to reject the application.

Heard the learned Counsel for the applicant, non-applicant No.2 and the learned A.P.P.

The victim has no objection to release the applicant on bail as the matter is settled between the parties, however, the application for quashing the First Information Report is pending before the Division Bench of this Court, this ground is sufficient to release the applicant on bail. Accordingly, I pass the following order: i) Criminal application is allowed.

ii) Applicant - Pramod @ Pappu s/o. Krishnakumar Awasthi be released on bail in Crime No.822/2024 registered with Police Station Kondhali, District Nagpur for the offences punishable under Sections 310(2), 318(4), 316(2), 204, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, on his furnishing P.R. Bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one solvent surety in the like amount.

3 29.ba.940.25 iii] The applicant shall not in any way tamper with the prosecution evidence.

iv] The applicant shall not pressurize or threaten the prosecution witnesses.

v] The applicant shall co-operate the investigation officer.
