This petition has been filed because the grievance of the petitioner that he be appointed on compassionate basis had gone unheard by the respondent nos.5 and 6. Now that the petitioner has been appointed on compassionate basis as Peon, the new development, in our opinion, renders the petition infructuous. Learned counsel for the petitioner submits that the proposal seeking approval to the appointment of the petitioner has been turned down lateron by the respondent no.4 and now the petitioner is desirous of challenging the order so passed by the Education Officer. For that purpose, the petitioner would have to file a fresh petition.

2 wp6455.19 In view of above, the petition is dismissed as infructuous with liberty to the petitioner to file fresh petition with fresh cause of action.
