On 25/11/2024, following order was passed :

" By present application, the applicant has raised a grievance that order dated 01/09/2023 passed by this Court has been not complied by Tahsildar, Mahagaon. By the said order, Tahsildar, Mahagaon was directed to ensure that the path way is made available to the petitioner from the field of respondent Nos.1 to3 in terms of order passed by the Sub-Divisional Officer with a further direction to remove obstruction, if any."

In response, the learned Assistant Government Pleader submits that the order dated 01/09/2023 passed by this Court has been complied with.

Since the order in question has been complied with, the grievance put forth through the present application stands redressed and no further order is required.

Having heard at length, the counsel for the petitioner seeks permission to withdraw the petition and approach the Tahsildar under Section 143 of the Maharashtra Land Revenue Code, 1966 as suggested by the Sub-Divisional Officer through the impugned order. 5.

The prayer is granted. Writ Petition is dismissed as withdrawn with liberty as prayed for.

If the petitioner files application before the Tahsildar under Section 143 of the Maharashtra Land Revenue Code, 1966, the Tahsildar shall consider and decide the same expeditiously and preferably within three months from the date of filing application. (Anil L. Pansare, J.) Asmita-PS
