The learned learned Additional Government Pleader Mr. Thakare, in compliance of the order dated 30.09.2024, has placed before us a report of the Zonal Officer addressed to the Food Supply Officer on 08.01.2024 in respect of the home visit for the purpose of making the quota of kerosene available to Smt. Ranjita Patle. 2.
The report dated 08.01.2024 record that a home enquiry was conducted to ascertain whether the two petitioners possess an LPG connection.

In the house of Smt. Ranjita Patle, one HP Company cylinder was found and she offered an explanation that this belongs to her husband's elder brother.

The Zonal Officer categorically reported to the Food Supply Officer that there is no gas connection in the name of Smt. Ranjita Patle.

As far as petitioner no.2 Smt. Megha w/o Satish Bais is concerned, her statement dated 31.10.2023 is to the effect that she does not have a gas cylinder and she used to cook the meals on a stove, but since the kerosene is now made available through government quota and since she is unable to purchase it from open market, she requested that she should be allotted kerosene through government quota.

Learned Additional Government Pleader has placed before us a copy of the Government Resolution dated 01.08.2018 in respect of the supply of kerosene and this is accompanied by an undertaking, which categorically expect the applicant to state whether the applicant has any gas connection and at any future point of time, if he/she avail a gas connection, then the supply of kerosene shall be discontinued.

Since we have noted that the respondent authority i.e. Food Supply Officer is not averse to allot kerosene to both the petitioners, but what is expected is, both of them shall fill in the
undertaking which is a part of the Government Resolution, dated 01.08.2018.

The learned counsel for the petitioners undertake that the necessary undertaking as contemplated shall be submitted to the Food Supply Officer within a period of one week from today. 9.
Pursuant to the undertaking being submitted, let Food Supply Officer promptly make available the kerosene quota to both the petitioners as per the applicable norms, within a period of one week thereafter.

With the above direction, the writ petition is disposed off.
