The present application has been filed for withdrawal of amount of Rs.45,300/- in this Court. It appears that by pursis dated 16.12.2016, the said amount came to be deposited with this Court, however, we cannot get any specific order to that effect. In the order dated 15.12.2016, there is a reference of the pursis which was filed, but it does not appear that this Court had directed the applicant to deposit the said amount. It has been stated by the learned Advocate for the applicant that the said amount of Rs.45,300/- was towards one month salary of the respondent No.2.

Now the main matter i.e. Criminal Application No.287 of 2016 has been disposed of by this Court on 29.10.2020. The respondent No.2 has been served, however, he has not raised any objection.

Since the respondent No.2 has not come forward to claim the said amount, there is no hurdle in allowing the applicant to withdraw the amount of Rs.45,300/-. However, we reject a prayer in respect of the interest.
