The applicant seeks suspension of sentence till conclusion of the appeal.

The applicant is convicted for the offence punishable under Section 326 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for two years and to pay fine of Rs.10,000/-.

Heard learned counsel for the applicant and learned APP for non-applicant/State.

The fine amount is already paid. Considering the quantum of punishment and the fact that while the applicant was on during trial did not bounce the bail bond. A case is made out for suspension of substantive sentence. 5.

Pending appeal substantive sentence imposed on the

6 apeal606.23.odt applicant in Special Case No.13/2021 shall remain suspended.

The applicant is released on bail on furnishing PR bond of Rs.25,000/- with one surety in the like amount. 7.

The applicant shall give undertaking to appear before this Court as and when directed.
