The learned Additional Public Prosecutor has submitted that the sessions trial was fixed for recording evidence on 20-01-2016. The learned Advocate for the applicant, on instructions, has stated that recording of evidence has not started on 20-01-2016 and now the matter is fixed on 16-02-2016. The learned Advocate for the applicant, on instructions, seeks permission to withdraw the application with liberty to file fresh application if the trial does not commence within two months.

The application is disposed as withdrawn with liberty as prayed for. In the circumstances, the parties to bear their own costs.
