DATE : November 06, 2017 By this application, it is prayed that the amount of Rs.48,125/- be permitted to be withdrawn by the nonapplicant. Pursuant to the order dated 14-10-2016, the applicant has deposited the aforesaid amount which is towards arrears of maintenance.

The application is opposed by the learned Counsel for the original applicant on the ground that the execution proceedings have been filed beyond limitation. Considering the earlier order passed on 14-10-2016, the non-applicant is permitted to withdraw the aforesaid amount subject to filing an undertaking within a period of four weeks from today in this Court that this withdrawal would be subject to final orders to be passed in the present proceedings and if the criminal application is allowed, the non-applicant would take steps to repay that amount.
