The statements of facts made in the application remain uncontroverted. The delay in filing the misc. civil application is condoned. The civil application is allowed and disposed of. MISC. CIVIL APPLICATION ST. NO.19717/2015 Heard the learned Counsel for the applicant. It would not be necessary to issue notice to the non-applicants on this civil application as the non-applicants were not represented in the Court on 17.6.2015 when the family court appeal was dismissed for want of prosecution.

2510cao293.16.odt For the reasons stated in the misc. civil application, the order, dated 17.6.2015 is set aside, subject to payment of costs of Rs.500/- (Rupees Five Hundred Only) to the High Court Bar Association, Nagpur within one week.
