SEPTEMBER 15, 2017 Heard learned counsel for the applicant for quite some time. When this Court was about to dismiss the application, the learned counsel for the applicant seeks leave to withdraw the present application. It is also brought to my notice that the trial has already begun and two witnesses have are already examined. However the trial is at a snail's pace.
In view of above, the application is dismissed as withdrawn. The learned Additional Sessions Judge, Chandrapur is directed to decide Sessions Case No. 81/2015 as expeditiously as possible and within a period of one year from today. The prosecution shall make an attempt to procure presence of the witnesses since speedy trial is the right of the accused who is languishing in jail.
