There is no reason to interfere in the order passed by the Central Government Industrial Tribunal, Nagpur ("CGIT") deciding the preliminary issued as to fairness of the enquiry. The findings recorded on this issue can be challenged after the ultimate decision in the dispute pending before the CGIT. The petition is dismissed. All questions are left open to be agitated in the appropriate proceedings.
