Shri R.D. Khade, learned counsel for the applicant and Shri S.S. Doifode, learned APP for the nonapplicant. Perused the evidence of the prosecutrix. The effort is to demonstrate that there is variance between her statement/ report and her deposition before the Court. The learned APP has submitted that on all material aspects of the prosecutrix remained consistent. A perusal of evidence shows that the prosecutrix has spoken about the necessary ingredients.
No case is, therefore, made out for suspending sentence. Application is rejected. No costs. However, considering the age of the applicant, we expedite hearing of the appeal.
