Heard finally with the consent of the learned Counsel for the parties. 2] The transfer of the petitioner to West Bengal prison has not been recommended by the Superintendent of Amravati Central Prison on the ground that there is no provision in the law or the Rules.

criwp808.19.odt 3] The learned counsel for the petitioner could not point out to us any provision in the Rules or law permitting such transfer. Therefore, we do not see any infirmity in the impugned order. The petition is dismissed.

4] The legal remuneration of Rs.2,000/- (Rupees Two Thousand) be paid to the learned appointed counsel. 5] Rule discharged.
