As the applicant is acquiring body and the presence of applicant being necessary for deciding the dispute involved between the parties, the application is allowed and the applicant is granted leave to file the appeal. Application is disposed of finally.

Learned counsel for appellant submits that he has now received the cheque of the amount of compensation and he may be permitted to deposit the same. Permission is granted.

In view thereof, the order of ad-interim stay granted is confirmed till the decision of the appeal.
