Heard the learned Counsel for the applicant and the learned A.P.P. for the State.
Perused the case-diary. On the basis of the complaint launched by the prosecutrix, offences of kidnapping, trafficking, extortion and criminal intimidation have been registered vide Crime No.49/2016 against this applicant and others, which are punishable under Sections 363, 366, 384 and 506 read with Section 34 of the Indian Penal Code.
From the statements of the witnesses, particularly the prosecutrix, it can be seen that there is sufficient material available on record indicating prima facie involvement of the applicant in commission of the offences. It appears that the prosecutrix has been prima facie induced by this applicant to
ba.818.16 2 go along with those who were the part of the racket, which sold girls to men in Rajasthan for the purpose of marriage against their will. The prosecutrix was handed over by this applicant to her husband for being taken to Indore in order to offer her catering work. But, after reaching Indore, the complainant was handed over to one Jyoti, who in turn handed over her to some other person, all the while, suppressing from her their real intentions. Later on, when the prosecutrix was compelled to perform marriage with a Rajasthani man, she could learn the real intention of this applicant and the co-accused.
This applicant is also involved in similar crime, being Crime No.38/2016 and it appears that she has formed the habit of prima facie committing such crimes. Therefore, there is a possibility of this applicant committing similar crime, if released on bail.
The application stands rejected.
