This is an application seeking condonation of delay of 190 days in filing the application for substituting the name of cross-objector and filing the application for setting aside the abatement.

For the reasons stated in the application, which are not controverted, the application is allowed. Delay stands condoned. The abatement is hereby quash and set aside. 4.

The application stands disposed of accordingly. 5.

In view of this order, the Civil Application No.952/2025 stands disposed of.

By this application, the applicants sought permission to substitute the name of cross-objector with the name of applicants.

In view of that the original cross-objector is

2 13.cao.950.2025 expired on 26.10.2024 and the contention of the application being not controverted as well as it will be beneficial to decide the present proceedings, the application is allowed. 9.

The applicants are permitted to substitute the name of cross-objector within a period of one week. 10.

Consequently, in the First Appeal No.338/2017 the name of respondent no.1 be substituted.

Necessary amendment be carried out within a week.

12.

The application stands disposed of accordingly. 13.
