Date : 01 st DECEMBER, 2015 Petitioner, who is in jail, sought his first furlough by application dated 11.3.2015. Same has been rejected on the ground that the wife of deceased, who is the complainant, expressed danger to her life. Advocate Khobragade submits that the rejection is on surmises and, therefore, cannot be sustained. APP submits that the police had conducted verification and as the wife of the deceased expressed danger to her life, same was communicated to the competent authority. We find the apprehension expressed by the wife of the deceased as misplaced, at least, at this stage. If there is any such apprehension, she can always report to the concerned police

0112wp802.15 authorities who can obtain appropriate bonds from the petitioner as also from his relatives to see that tranquility and peace in the area is not disturbed. He can also be asked to report to the local police station at frequent intervals.

Therefore, we set aside the impugned order dated 22.4.2015. The petitioner shall be released on furlough after he submits necessary bonds and undertaking. Writ petition allowed in above terms.
