The Petitioner's grievance is that the Petitioner, though is entitled to the benefits of fixation of pay as per VI and VII Pay Commissions, including the dearness allowance, the RespondentCollege where the Petitioner is working, is not disbursing the amounts. The learned Counsel for the Petitioner states that the Petitioner has made a complaint to Rashtrasant Tukdoji Maharaj Nagpur University. However, even the University has not looked

WP.1490.22 into the grievance of the Petitioner.

Under the Maharashtra Universities Act 1994, the University which grants affiliation to the educational institutions has ample supervisory powers over the affiliated educational Institutes. The University also can lay down norms as regards the performance of the teachers. If the salary as per the pay-scales which are applicable to the teachers is not being paid, it affects the performance of the teachers. Therefore, the University should also be concerned if the teachers from affiliated Colleges are not being paid as per the applicable rules and regulations. 4.

The Petitioner will bring the grievance of the Petitioner that Respondent-educational Institute is not paying the Petitioner the salary as per the applicable pay-scales to the notice of the concerned University. Once his representation/complaint is received, after scrutinizing the representation if it is found that there is merit in the grievance of the Petitioner, the University call for the explanation from the Respondent-College and proceed to issue necessary directions as per law and ensure that they are enforced. 4.

With these observations, the Writ Petition is disposed of.
