The petitioner seeks to raise a challenge to the rejection of his technical bid on the ground that the documents with regard to possession of one loader and water tanker were not annexed along with the documents furnished with the technical bid. It is urged that in the tender notice there is no mention of the fact that possession of a loader and water tanker is necessary. 3.
In the reply filed on behalf of the respondent, copy of the entire tender notice along with the annexures is annexed. Annexure-3 refers to information to be supplied with regard to possession of a tractor, other equipment including water tanker. It is further stated in the affidavit that by incorrectly mentioning absence of such requirement, the petitioner seeks to challenge the rejection of his technical bid.

Having heard the learned counsel for the parties and having perused the documents on record, it is clear that the
2 wp 5913.23 requirement of the items mentioned in annexure-3 form part of the tender notice. These items include water tanker and loader. Having participated in the tender process, it would not be permissible for the petitioner to turn around and raise a grievance that requirement of possession of these items was not sought.

We do not find any illegality in the rejection of the petitioner's technical bid. The Writ Petition is therefore dismissed. 6.
Civil application is also disposed of.
