This petition takes exception to the order dated 27.08.2024 passed by learned Civil Judge, Senior Division, Nagpur below Exh.75 in Special Civil Suit No.449/2017. Respondent herein has filed a suit for declaration, eviction, possession, mandatory injunction etc. against the petitioners.

By the order impugned, the learned trial Court has rejected the application filed by the petitioners under Order 1 Rule 10 of the Code of Civil Procedure.

The learned trial Court has rightly rejected the application as the same can not be entertained at the instance of petitioners/defendants. No interference is thus
