JULY 23, 2025 This is an application seeking quashment of First Information Report lodged by non-applicant no.2 against the applicants, which was registered under Sections 498A and 506 of the Indian Penal Code, 1860, and Section 4 of the Dowry Prohibition Act, 1961. 2] The parties have decided to settle the dispute, and accordingly, a deed of settlement was submitted before the Family Court. The proceedings before the Family Court are disposed of in terms of the settlement.
3] The parties are present before the Court. We have interacted with both to find that they have willingly arrived at the settlement. That being so, continuation of prosecution will serve no purpose, rather will amount to abuse of process.
4] Accordingly, the application is allowed in terms of prayer Clause (i), which reads as under :
904-APL-1553-2022 "i) quash and set aside the First Information Report vide Crime No. 0721/2020 for the offences punishable under Section 498-A, 506 of Indian Penal Code R/w Section 4 of Dowry Prohibition Act dated 21.11.2020 (AnnexureA) registered with non-applicant-Police Station Lakadganj, Nagpur and charge-sheet registered as Regular Criminal Case No. 1592/2021 pending on the file of learned Judicial Magistrate First Class Court No.3, Nagpur;"
5] The application is disposed of in above terms.
