Learned counsel for applicant/respondent No.3 does not press this application in view of Civil Application (CAF) No.2561 of 2015 filed later on.

Accordingly, Civil Application (CAF) No.3377 of 2014 is disposed of.

Original respondent No.3, in the first appeal, is the applicant in this application.

Prayer is to point out subsequent developments .....2/-

fa751.96 and, therefore, to delete name of Govindrao Marotrao Wanjari as Chairman of respondent No.3 Society. It is pointed out that Ajay Madhukarrao Mahakalkar is current Chairman and hence, he should be substituted in place of Govindrao Marotrao Wanjari.

The application is served upon the appellant on 7.10.2015. Even earlier Civil Application (CAF) No.3377 of 2014 sought identical direction and it was served upon the appellant on 26.11.2014. The appellant has not filed the reply to any application.

Thus, the appellant is aware of the developments and has still not taken any steps after demise of Govindrao Marotrao Wanjari.

In this situation, without prejudice to the rights of respondent No.3 and Shri Ajay Madhukarrao Mahakalkar, we dispose of Civil Application (CAF) No.2561 of 2015.
