By this application, the applicant is seeking condonation of delay which is caused in preferring the appeal against the conviction.

As per the contention of the applicant, he is the sole earning member of his family, which consists of elderly parents suffering from various ailments. The applicant is in jail since his conviction and there was nobody to arrange for his defence and therefore, he could not file the appeal.

Learned APP strongly opposed the said application on the ground that there is no reasonable and justifiable cause for condoning the delay. 4.

On perusal of the application, there appears to be a just and sufficient reason. Moreover, if the delay is not condoned, the statutory right of the present rkn

7appa704.2025.odt applicant to prefer an appeal would be affected. In view of this, the delay of 598 days is condoned.

Appeal be registered. On registration of the appeal, learned APP waives service of notice on behalf of respondent/State.
