Challenge in the present writ petition is to order dated 12.09.2017 passed by the State Consumer Redressal Commission dismissing the revision application as filed by the present petitioner. A preliminary objection is raised on behalf of the respondent No. 2 that after the order dated 12.09.2017 was passed, the petitioners had filed a miscellaneous application before the State Consumer Redressal Commission for recalling of that order and those proceedings have been dismissed on 22.06.2018. It is submitted that the further remedy before the National Commission is available to the petitioners and hence the writ petition does not deserve

2 WP6686.18 to be entertained.

In the light of the fact that the miscellaneous application No. 18/2001 has been decided on 22.06.2018 by the State Consumer Redressal Commission and remedy of challenging this order before the National Commission is available to the petitioner, I am not inclined to entertain the present writ petition. With liberty to the petitioner to avail the statutory remedy and by continuing the ad-interim relief granted on 9th October, 2018 for a period of three weeks from today, the writ petition is disposed of. The points raised in the writ petition are kept open for being urged before the National Commission.
