CORAM

:

A. B. CHAUDHARI, J.

DATE :

02nd December, 2015.

Heard learned counsel for the rival parties.

In connection with Crime No. 293/15 registered with Police Station, Dharni, Distt. Amravati, for the offences punishable under Sections 498-A and 306 of Indian Penal Code, the applicant was arrested on 25th August, 2015 and is in jail since then.

Learned APP submits that the charge-sheet is on the verge of being filed after completion of investigation. In my opinion, the offence is alleged to have been committed in August, 2015, and by this time the chargesheet should have been filed. Nevertheless, even on merits, upon perusal of the

report, there is no allegation about any unlawful demand by the applicant as a reason for commission of suicide by the victim.

Be that as it may, further detention of the applicant is not necessary. Hence the following order:-

O R D E R

[a] Criminal Application No. 781 of 2015 is allowed.

[b] Applicant shall be released on bail upon furnishing a Personal Bond in a sum of Rs.

[c] Applicant shall report to Dharni Police Station on last Sunday of every month between 02.00 p.m., and 4.00 p.m.
