The Petitioner - State has challenged the order passed by the Maharashtra Administrative Tribunal, Nagpur dated 31 July 2008 setting aside the order dated 30 May 2008 transferring the Respondents from the post of Assistant Executive Engineer, Akola to Deputy Engineer, Zilla Parishad, Buldhana. 2.

On 19 December 2008, Rule was issued in this Petition and it was noted that by way of corrigendum the Respondents' transfer was made to the post of Assistant Executive Engineer. The Division Bench stayed the order passed by the Tribunal and directed the Respondents to join at the transferred place. It has been 13 years since the order has been passed. The MP Deshpande

2 / 2 222-WP-5337-2008 service of the Respondents must have undergone further transfers and, therefore, the cause raised in this Petition does not survive. 3.

The Writ Petition is accordingly disposed of as infructuous. Rules is discharged.
