It has transpired that the order impugned was earlier assailed by the petitioner in Writ Petition 4706/2021 which was disposed of vide order dated 24.11.2021, which reads thus:

After hearing for some time, as the Court was not inclined to allow the petition, Mr. Fidvi, learned counsel for the petitioner, on instructions, seeks to withdraw the petition, with liberty to approach in the suits pending before the Civil Courts in respect of the property, which is the subject matter of the present petition, by way of appropriate application, in case they are so permissible in law.

The Writ Petition stands disposed of, as withdrawn with the aforesaid liberty.

The petitioner has suppressed the fact that the very same order was earlier challenged and since the Court

The petition is dismissed.
