Mr.C.A. Joshi, learned advocate for the petitioner, on instructions, seeks permission to withdraw the petition. The learned advocate submits that he will prosecute the application filed by the petitioner under Order 9 Rule 13 of the Code of Civil Procedure, according to law. None appears for the respondent.

The petitioner is permitted to withdraw the writ petition with liberty to prosecute the application filed by him under Order 9 Rule 13 of the Code of Civil Procedure, according to law.

The petitioner shall deposit Rs.Five Hundred with High Court Legal Services Sub-Committee, Nagpur and produce the receipt on the record of the trial Court within one month, failing which the learned trial Court shall pass appropriate orders for non-compliance of the order passed by this Court.
