The only prayer made by the petitioner is for a direction to the respondent no.1 to decide the proposal for appointment of the petitioner on the post of driver. It is stated on behalf of the respondent nos.1 to 3 that the respondents have not received the proposal sent by the Management for grant of approval to the appointment of the petitioner. We, however, find on a perusal of the affidavit-in-reply filed on behalf of the respondent nos. 4 and 5 and the documents annexed thereto that the proposal of the petitioner was forwarded
to the Assistant Commissioner, Social Welfare Department, Wardha, so that it could be sent to the respondent no.1, Commissioner.
Since the prayer made by the petitioner is innocuous, we direct the respondent no.1 to decide the proposal of the petitioner, as early as possible, and positively within a period of twelve weeks. Even if the respondent no.1 has not received the proposal, the respondent no.1 should consider the copy of the proposal annexed by the respondent nos. 4 and 5 to their affidavitin-reply. Order accordingly. No costs.
Copy of this order be supplied to the learned AGP Shri Rao.
