This is an application for regular bail.

Though the case is coming for the first time , learned A.P.P. has complete instructions in the matter. Not only that, he has tendered the reply which is taken on record.

The applicant is arrested in connection with Crime No.1201/2017, registered with P.S.Ramnagar, Chandrapur, for the offence punishable under Sections 65(a) and 83 of Maharashtra Prohibition Act and Section 188 of the Indian Penal Code. He is arrested on 29/7/2017 and since then he is in jail. According to reply when the police party searched a truck which was standing near Jain Petrol Pump that time it was noticed that applicant and others were unloading the contraband i.e. liquor. The liquor is already seized. The applicant is in jail since 29/7/2017.

Though the chargesheet is not filed it is clear that in so far as the present applicant is concerned the investigation is already over. Further, there is no reason putforth by the prosecution for further custodial presence of the present applicant. That leads me to pass the following order.

ORDER

I) The application is allowed.

II) The applicant Vinod @ Manoj S/o Bharat Tekam be released on bail in Crime No.1201/2017, registered with P.S.Ramnagar, Chandrapur, for the offence punishable under Sections 65(a) and 83 of Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, on he executing P.B. of Rs.

15000/- with two solvent sureties in the like amount.

III) The applicant shall attend P.S.Ramnagar, Chandrapur once in a month i.e. last Saturday of each month in between 3.00 p.m. to 5.00 p.m. till filing of the chargesheet.

With this application is disposed of.
