By this application, the applicant is seeking suspension of sentence and releasing the applicant on bail.

The applicant was prosecuted for the offence punishable under Sections 294 and 506(ii) of the Indian Penal Code, 1860, and held him guilty for the offence punishable under Sections 294 and 506(ii) of the IPC, and sentenced to suffer Simple Imprisonment of two months and fine of Rs. 1,000/-. The said conviction is confirmed by the Additional Sessions Judge, Warud, in criminal appeal No. 72/2023.

Learned counsel for the applicant submitted that the applicant has every chance of success in the present revision. However, revision would take its own time for its final disposal. Moreover, the punishment imposed is of a limited period. In view of that, the
execution of the sentence is suspended, and the applicant be released on bail.

Leaned APP strongly opposed the said application and submitted that revision application be devoid of merits and liable to be dismissed.

On perusal of the impugned judgment of both the courts, admittedly the punishment imposed is of a limited period. The revision would take its own time for its final disposal. In view of that, the application deserves to be allowed. Accordingly, I proceed to pass the following order.
a] The criminal application is allowed.
b] The execution of the sentence passed in RCC No. 241/2013 confirmed in Criminal Appeal No. 72/2023 is hereby suspended till disposal of the criminal revision.
c] The applicant shall be released on bail on executing P.R. Bond of Rs. 25,000/- with one surety of like amount.

The criminal application is disposed of.
