Considering the facts on the record and as there is no chance of hearing of the appeal in near future, the sentence imposed on the appellant is suspended, however, on conditions as stated in this order.

(i) The appellant shall provisionally deposit Rs.1,00,000/- with the Registry of this Court as security for compensation to the victim, if order is passed in that regards at the time of final hearing of the appeal.

The amount shall be kept in fixed deposit in nationalized bank.

2 appa668.15 (ii) On deposit of the above amount, the sentence imposed on the appellant shall stand suspended and the appellant be released on bail on same terms as before the Sessions Court. (iii) The application is allowed accordingly.
