DATE : 25/10/2021 Mr. Deshpande, learned counsel for the petitioner submits that since the entire claim of the respondent No.1 bank has been settled, which position is admitted by Mr. Tidke, learned counsel for Respondent No.1, the petition has worked itself out, however, the claim of compensation remains to be decided, for which the petitioner shall file appropriate proceedings, for which liberty be granted.

Accepting the above statement, the petition is dismissed as having been worked out as regards prayer clause (i), with the liberty to file appropriate proceedings for compensation before the appropriate forum, if so permissible in law.

In view of the above, Civil Application No.

1545/21, by which the applicant Mr. Suyash Madhukarrao

wp5660.10.odt Bhusari, seeks to withdraw the amount of Rs.6,00.000/- as deposited in this Court, in view of the admitted position that this amount has been deposited by the applicant as is reflected from the pursis dated 5.3.2011 and the order of this Court dated 25.4.2011, is allowed.

The Civil Application No. 1544/2021 is rejected.
