IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

WRIT PETITION NO. 571/2005.

Subhash Govind Aprajit -VERSUSState of Maharashtra and another Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders or directions and Registrar's orders.

CORAM

: B.P. DHARMADHIKARI & P.N. DESHMUKH, JJ.

DATE : APRIL 27, 2016.

Heard Shri A. Parchure with Shri Dharaskar, learned Counsel for petitioner and Ms. Hiwase, learned A.G.P. for respondent no.1. None appears for respondent no.2.

2.

Learned counsel for petitioner has invited our attention to observations in order dated 18.02.2005 passed by this Court while issuing Rule in the matter.

3.

We find that the SLP (Civil) No.

8287/2005 filed against that order by the present petitioner was also dismissed. It is therefore, apparent that challenge was on the eve of election and after that

Order 2704wp571.05 election in the year 2005, more than one election must have been held by now. Therefore by passage of time challenge in present petition is rendered infructuous. Writ Petition is, therefore, disposed of as infructuous. Rule discharged. No costs.
