DATE : 16/12/2022 Civil Application (F) No.2352/2022 seeks withdrawal of the amount of Rs.37,237/- along with interest accrued and further direction to the appellant Insurance Company to pay the deficit amount as indicated therein.

Mrs. Mategaonkar for the appellant is absent, considering which the application is party allowed by permitting withdrawal of the amount of Rs.37,237/- with accrued interest.

In so far as the relief claimed in prayer clause (2) is concerned, Mr. Bhoyar, learned counsel for the applicant withdraws the same, with liberty to file afresh, which is granted.
