The applicant is arrested in connection with Crime No.517/2017 registered with Police Station, Warora for an offence punishable under Sections 376 (2) (i) (j) and 452 of the Indian Penal Code and Sections 3, 4 and 8 of the Protection of Children From Sexual Offences Act, 2012.
There is a delay in lodging the FIR. No doubt, the delay will be explained at an appropriate stage. However, looking to the nature of the accusations made against the present applicant, I am of the view that since entire investigation is over and charge-sheet is already filed, further custodial presence of the present applicant is not necessary.
Hence, following order is passed.
ORDER
ba870.17.odt (i) Criminal Application No.870/2017 is allowed.
(ii) Applicant-Vinod Shankar Sasane be released on bail in connection with Crime No.517/2017 registered with Police Station, Warora for an offence punishable under Sections 376 (2) (i) (j) and 452 of the Indian Penal Code and Sections 3, 4 and 8 of the Protection of Children From Sexual Offences Act, 2012 on he executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant shall not try to contact the victim or any of the prosecution witness nor shall try to influence any of the prosecution witness.
The application stands disposed of.
